1. Platform as Public Record
Malpracticed operates as a public accountability registry for medical practitioners and facilities. Reports filed on this platform are treated as public declarations, similar in nature to court filings, regulatory complaints, or public notice records.
All reports are cryptographically hashed (SHA-256), appended to an immutable hash-chain ledger, and timestamped on the Bitcoin blockchain via OpenTimestamps. Once filed, reports cannot be deleted, modified, or silently altered. This immutability is by design and is fundamental to the platform's integrity.
2. Sworn Declarations
Sworn filings on Malpracticed constitute legal declarations made under penalty of perjury. By choosing the "sworn" filing type, the declarant affirms that the information provided is true, accurate, and complete to the best of their knowledge.
Filing a knowingly false sworn declaration may result in legal consequences under applicable jurisdiction. Malpracticed retains the identity of sworn declarants in encrypted storage and may be compelled to disclose this information pursuant to valid legal process.
3. User Responsibilities
- You agree to file reports in good faith and based on genuine personal experience or credible knowledge.
- You agree not to file reports for the purpose of harassment, extortion, defamation, or competitive sabotage.
- You agree not to impersonate another person or entity when filing reports or responses.
- You agree not to attempt to circumvent the payment system, credit system, or rate limiting.
- You agree not to scrape the platform at rates exceeding the published API rate limits.
4. Right of Response
All practitioners and facilities named in reports have an absolute right to file an official response. Responses are displayed alongside the original report and are also hash-chain ledgered and timestamped. Response filing requires identity verification and proof of licensure or employment. Malpracticed charges a filing fee for responses to deter abuse.
5. No Legal or Medical Advice
Nothing on Malpracticed constitutes legal advice, medical advice, or a professional recommendation. The trust scoring algorithm is mathematical and algorithmic, not editorial or judgmental. If you have been harmed by medical malpractice, consult a qualified attorney in your jurisdiction. If you are experiencing a medical emergency, contact your local emergency services.
6. Limitation of Liability
Malpracticed provides a platform for public accountability records. We do not independently verify the accuracy of individual reports. We do not endorse, approve, or authenticate any specific claim made by any user.
To the maximum extent permitted by law, Malpracticed, its operators, and the Soteria Global Trust shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of this platform or reliance on information published herein.
7. Intellectual Property
Report data submitted by users becomes part of the public record. The Malpracticed name, logos, and design are the property of Soteria Global Trust. The underlying platform code, algorithms, and infrastructure are proprietary.
8. Governing Law
These terms are governed by natural law and the common law of the land. Disputes shall be resolved through private arbitration or the applicable common law jurisdiction. By using Malpracticed, you consent to the jurisdiction and venue of such proceedings.
9. Changes to Terms
We may update these terms from time to time. Material changes will be announced via the News page and displayed prominently on the platform. Continued use of Malpracticed after changes constitutes acceptance of the updated terms.
